As Republicans gear up to take control of Congress and the White House, some Democrats have begun coming up with conspiracy theories to scare their base, claiming that Republicans will convene a constitutional convention. With 28 state legislatures under Republican control and growing calls for constitutional amendments, concerns about a potential “runaway convention” are mounting among Democratic lawmakers.
California State Senator Scott Wiener is leading efforts to block such a convention, according to a report. On Monday, Wiener plans to introduce legislation to withdraw California’s seven active calls for a constitutional convention, some of which date back over a century. “I don’t want California to unintentionally trigger a constitutional convention that could dismantle the Constitution,” Wiener said.
The issue arises from Article V of the Constitution, which permits Congress to organize a constitutional convention if two-thirds of state legislatures—34 out of 50—call for it. Although this provision has never been invoked, some state applications remain valid and could theoretically help meet the required threshold.
Democrats fear that Republicans could use a convention to push a conservative agenda under the pretext of addressing issues like balancing the federal budget. However, once convened, a convention could open the door to sweeping changes, such as restricting abortion rights, limiting civil liberties, or reducing federal authority.
The lack of clear guidelines in the Constitution adds to the uncertainty. Article V does not outline how states would vote, whether the agenda could expand beyond its original scope, or how disputes would be handled during a convention.
Proponents of a convention, such as Representative Jodey Arrington (R-Texas), argue that it is long overdue. Arrington has introduced legislation to monitor state applications, claiming that a convention should have been called as early as 1979. Former Comptroller General David Walker has suggested that states could even sue Congress for failing to act on their applications.
Since 2016, nine states with Democratic majorities have rescinded their calls for a convention, citing concerns about the risks of a Republican-controlled process. States like Vermont, Massachusetts, and Connecticut have considered similar measures but have yet to finalize them.
California’s existing calls for a convention include outdated proposals, such as campaign finance reform, motor vehicle tax adjustments, and even a 1949-era request for the creation of a world federal government.
If Wiener’s legislation passes, California would join a growing number of Democratic-led states working to withdraw their calls and prevent a constitutional rewrite under Republican leadership.
Ambiguity in Article V leaves uncertainties. Georgetown University law professor David Super warns that if Congress determines the threshold has been met, a convention could still be convened. “Once Congress makes that declaration, we’re on the path to a convention,” Super explained to The New York Times.

The “war mongering myths” about the Article V Convention of States is JUST THAT a myth. The truth of the matter is the Article V Convention was created and included to allow “we the people” to have a method of proposing “amendments” to the Constitution. One has never been held. The reason is the process to lead up to a convention is controlled by the “political establishment” . It is the state legislatures that hold the process hostage because they do not want “we the people” to be able to exercise our Constitutional rights. State legislatures as well as Congress refuse the American people their enumerated rights because “they don’t want the people to have any say in how the governments operate. Firstly, they know the first thing that will be changed by the people is “term limits” for all of Congress. Oh, people like Ted Cruz and a few others threaten to bring term limits up but it will never happen. So the only process we have it to kick most incumbent politicians out of office and replace them with people who sign a binding contract that they will support “term limits” when a bill is brought to the floor. This strangle hold by the political establishment MUST BE ABOLISHED. To find out what I am saying is true, contact your state and federl representatives and ask them for their opinion. You will see just how accurate by comments are. They will not support a Article V Convention because it takes their power away.
