Democrats have had their hearts broken again. Despite calls from the left to do so, Supreme Court Justice Sonia Sotomayor has signaled she has no plans to retire.
Sources close to the 70-year-old justice told CNN that she’s in good health and remains deeply committed to her role on the court.
“She’s in great health, and the court needs her now more than ever,” said one person close to the justice.
Some progressives have suggested Sotomayor, the most senior liberal on the conservative Supreme Court, should step down so that Biden could try to name a replacement in the short window before Trump takes office in January. Talk has simmered for months over the possibility of Sotomayor retiring so that Biden could name a successor and ensure the seat remains a reliable vote for the liberal wing, but that has gone nowhere.
Vermont Sen. Bernie Sanders said Sunday that he doesn’t think Sotomayor should step down from the court.
“I don’t think it’s sensible,” Sanders, an independent who caucuses with Senate Democrats, said on NBC’s “Meet the Press.”
Earlier in the week, CNN commentator Bakari Sellers suggested that Democrats could push Sotomayor out of her position on the Supreme Court and replace her with Kamala Harris, giving the failed candidate a kind of participation trophy.
Despite her diagnosis of type 1 diabetes and sometimes traveling with a medic, Sotomayor remains active and engaged, participating vigorously in court arguments and public events.
In May, she shared her emotional response to recent court decisions, admitting to an audience at Harvard that some rulings have moved her to tears. Speaking earlier at the University of California, Berkeley, she acknowledged feeling “frustration” over the court’s direction.
“Every loss truly affects me deeply,” she said. “But I get up the next morning and keep fighting.”
For now, Sotomayor seems steadfast in her commitment to serving on the Supreme Court, standing firm regardless of who the president is.

That’s okay. Trump is still probably going to nominate two justices anyway. Both Thomas and Alito are probably ready to retire. It won’t change the court but it will effect the courts conservative time period.
