The controversy dates back to Harris’ tenure as California attorney general when she initiated an investigation into citizen journalist David Daleiden. Daleiden had gone undercover to expose Planned Parenthood’s alleged involvement in fetal tissue trafficking, a move that led to significant legal repercussions for him. His home was raided by Harris’ office, and his materials, including a computer, were seized. Daleiden and his colleague Sandra Merritt were later charged under a law that he claims had never before been applied to an undercover journalist.
Daleiden argues that Harris’ actions were a deliberate attempt to stifle dissent against powerful interests like the abortion industry. “Her record shows that she is eager to weaponize the powers of her governmental office…in order to chill the First Amendment speech rights of people who disagree with her,” Daleiden told The Daily Caller.
These concerns are underscored by the increased prosecutions of pro-life activists since Harris became vice president. Daleiden sees this as a continuation of what he describes as a pattern in Harris’ career—a willingness to use legal power to target political opponents.
The recent release of unedited footage from Daleiden’s 2015 investigation has brought these issues back into the spotlight. The videos, now public due to efforts by Republican Georgia Rep. Marjorie Taylor Greene, include statements from Planned Parenthood officials that have further fueled the controversy. One video shows Tram Nguyen, a vice president at Planned Parenthood Gulf Coast, making remarks that Daleiden argues reflect a troubling attitude toward fetal tissue handling.

Planned Parenthood has consistently denied any wrongdoing, asserting that Daleiden’s videos were misleadingly edited. The organization ceased accepting reimbursements for costs associated with donating tissue in 2015, following public outcry.
Harris has not publicly addressed the content of Daleiden’s videos or the recent developments, fueling speculation and concern among her critics. As Harris remains a central figure in the Biden administration, her past and potential future actions continue to be a flashpoint in the national debate over abortion rights and free speech.
The Daily Caller wrote that “as California attorney general, Harris also backed and defended a law — which was eventually rejected by the Supreme Court based on the First Amendment — that required California’s pro-life pregnancy centers to advertise abortion services.
The Supreme Court held that the law ‘imposes an unduly burdensome disclosure requirement that will chill their protected speech.’
“The Biden-Harris Department of ‘Injustice’ has been weaponized against pro-lifers and political enemies again and again,” Republican Virginia Rep. Bob Good told the The Daily Caller, The congressman added that the Harris prosecution of Daleiden should “send a chill down the spine of every American.”
“We would be wrong to think she wouldn’t do it again from the White House,” Good continued.
Of all the cases brought under the Freedom of Access to Clinics (FACE) Act from 1994 to 2024, nearly 97% of the 205 cases were prosecutions against pro-life activists, according to the outlet.
